Unfortunately, Tom, along with his disciples Iceburg and Franky, was framed by Spandam, the leader of CP5, who wanted the blueprints for the ancient weapon Pluton.
They were blamed for attacking a government ship, an act they did not commit.
When the three were brought before him, Jorge looked sad and disappointed.
Jorge Honors Tom's Last Wish
Tom asked Jorge not to punish him for the false charge, but to proceed with the original charge of building the Pirate King’s ship.
Tom wanted only himself to be punished and hoped Iceburg and Franky would be released.

Three-headed judge Baskerville then took over as the new chief judge of Enies Lobby.

He kept his word and honored Tom’s final request.
